Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Freedom AC and Heating website (the “Site”), including any forms, scheduling tools, and online estimate tools, as well as any service requests and services provided by Freedom AC and Heating (“Freedom AC and Heating,” “we,” “us,” “our”). By using the Site, requesting service, booking an appointment, or communicating with us, you agree to these Terms.

You agree to use the Site only for lawful purposes and in a manner that does not interfere with the Site’s security, availability, or functionality. You may not attempt unauthorized access, introduce harmful code, scrape, or misuse Site content. We may modify, suspend, or discontinue any portion of the Site at any time.
3) Service Requests, Scheduling, and Availability
Submitting a form, requesting service, or booking an appointment authorizes us to contact you to confirm details and schedule service. Appointments are not final until confirmed by us and are subject to technician availability, parts availability, and service area coverage.
Same-day service may be available when scheduling allows. After-hours or weekend emergency service may be available for true no-cool or no-heat situations and may involve additional fees, which we will communicate when reasonably possible.
4) Estimates, Diagnosis, and Scope Changes
Any estimate, recommendation, or pricing provided (including preliminary pricing) may change based on onsite verification, code requirements, access conditions, equipment availability, and issues discovered during diagnosis.
If conditions require work beyond the original scope, we will present updated options and pricing for approval before proceeding, except where immediate action is required to address safety concerns or prevent property damage.
5) Online Estimate Builder Disclaimer
Any online estimate tool, pricing range, or informational pricing displayed on the Site is provided for general informational purposes only. It is not a final quote and is not a binding offer. Final scope and pricing are confirmed after onsite evaluation and documented approval.
6) Customer Responsibilities (Access, Safety, Utilities)
You agree to provide safe and reasonable access to all equipment and work areas, ensure that utilities required for service (electricity, gas, water, etc.) are available as needed, and secure pets.
You agree to disclose known or suspected hazards or conditions, including (without limitation) electrical problems, pests or rodents, mold or asbestos, structural concerns, or unsafe access conditions.
We may pause or refuse work if conditions are unsafe or if hazards are discovered that were not previously disclosed.
8) Payments
Payment terms will be stated on your estimate, proposal, invoice, or installation agreement. Unless otherwise stated in writing, payment is due upon completion of service. For installations or larger projects, deposits and or progress payments may apply as specified in the installation agreement.
9) Cancellations, Rescheduling, and No-Shows
Please notify us as soon as possible if you need to cancel or reschedule. A late cancellation or no-show fee may apply only if it is disclosed at booking or during appointment confirmation.
10) Permits and Code Compliance
Where required by law, permits will be obtained and work will be performed in accordance with applicable codes. Inspection scheduling and permit processing may affect timelines.
11) Warranties
A) New system installations: Comfort Club requirement
We offer a 10-Year Parts and Labor Warranty on new system installations with an active Freedom Comfort Club membership for the duration of the warranty period. “Active membership” means the membership remains in good standing (including timely payments) and the system receives required maintenance under the membership plan and or manufacturer requirements.
If Freedom Comfort Club membership ends or is canceled, the 10-Year Parts and Labor Warranty under this program ends as of the membership end date. Manufacturer warranties (if any) may still apply under their separate terms.
This warranty is subject to your written installation agreement or invoice, manufacturer policies and registration requirements, and standard exclusions, including (without limitation): misuse, lack of required maintenance, unauthorized modifications or repairs, acts of nature, power surges, pest or rodent damage, and pre-existing or site conditions outside our control.

B) Repairs and service work
Any workmanship coverage for repairs or service work (if applicable) will be described on your invoice or written estimate.
12) Financing
Financing options may be available through third-party providers. Financing is subject to approval and the lender’s terms. We do not control lender decisions, rates, fees, or final terms.

13) Communications (Text and Email) and Call Recording
By providing your phone number and or email address, you consent to receive communications related to your request, including appointment confirmations, service updates, and follow-ups.

Reply STOP to opt out of marketing texts. Message and data rates may apply.
Call recording
Calls may be recorded for quality assurance and training. If you do not want a call recorded, please state so at the beginning of the call and we can communicate by another method when available.
14) Third-Party Tools and Links
The Site may include third-party tools (such as scheduling, chat, or forms) or links to third-party sites. We are not responsible for third-party content, policies, security, availability, or practices.
15) Intellectual Property
All Site content (including text, graphics, logos, and other materials) is owned by or licensed to Freedom AC and Heating and is protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or exploit Site content without our prior written permission.
16) Disclaimers
The Site is provided on an “as is” and “as available” basis. We do not guarantee that the Site will be uninterrupted, timely, secure, or error-free.
17) Limitation of Liability
To the fullest extent permitted by law, Freedom AC and Heating will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services.
To the fullest extent permitted by law, our total liability for any claim related to a specific service will not exceed the amount you paid for the service at issue, unless a higher amount is required by law.
18) Indemnification
You agree to defend, indemnify, and hold harmless Freedom AC and Heating from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your misuse of the Site, (b) your violation of these Terms, or (c) unsafe conditions at the service location or your failure to disclose known hazards.
19) Governing Law and Venue
These Terms are governed by California law, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms, the Site, or services will be brought in the appropriate state or federal courts located in Orange County, California, unless otherwise required by law.
20) Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Site or services after changes are posted constitutes acceptance of the updated Terms.
